Chief Justice John Roberts reportedly wants no part of Trump's impeachment trial

Constitutionally-speaking, Chief Justice John Roberts is meant to
preside over President Trump's impeachment trial, but he apparently
wants out, Politico reports.
Multiple Republican and Democratic sources have reportedly told
Politico that Roberts is seeking a way to avoid the job because of how
things played out when he oversaw Trump's first impeachment trial last
year. Roberts, Politico notes, has worked hard to keep the Supreme
Court apolitical during his tenure, so he was reportedly displeased
that he "became a top target of the left" during the proceedings. "He
wants no further part of this," one source told Politico, although
there's been no official word from Roberts' camp about what he'll
ultimately do.
Trump's trial is a bit of a constitutional oddity. On the one hand,
it's a presidential impeachment, but on the other hand, the trial will
take place after he leaves office, which is why there's a chance
Roberts may have some wiggle room. Historically, either the vice
president or the longest-serving member of the Senate have taken up the
mantle for lower-level impeachments, per Politico. That means Vice
President-elect Kamala Harris or Sen. Patrick Leahy (D-Vt.) could be
the choice.

Why would Harris not be eligible?
The Senate shall have the sole Power to try all Impeachments. When
sitting for that Purpose, they shall be on Oath or Affirmation. When the
President of the United States is tried, *the Chief Justice shall*
*preside* : And no Person shall be convicted without the Concurrence of
two thirds of the Members present.

And where does it say you can IMPEACH and TRY A CITIZEN who is NOT in
office?

The powers not delegated to the United States by the Constitution, nor
prohibited by it to the States, are reserved to the States respectively,
or to the people.

The Impeachment clause would have to tell the Congress who they can
impeach and NOT who they CAN'T impeach. And it doesn't say they can
impeach citizens NOT actively in public office. I thought it could be
done to remove retirement but that ship has also sailed... They wasted
too much time in Congress and got NOTHING done so now they pay for their
ignorance. They can't try TRUMP in the Senate impeachment. Congressional
rules or NOT the Constitution doesn't allow for it since you can't
remove a person from an office they are NOT actually occupying.

The ONLY process left to Democrats it "INDICTMENT" and a trial in the
JUSTICE SYSTEM. The actual time for an impeachment trial in the Senate
has passed and Justice Roberts knows it and that's why he's trying to
shy away from presiding over the Senate TRIAL.


*Judgment in Cases of Impeachment* shall not extend further than to
removal from Office, and disqualification to hold and enjoy any Office
of honor, Trust or Profit under the United States: *but the Party*
*convicted shall nevertheless* be liable and *subject to Indictment* ,
*Trial, Judgment and Punishment, according to Law* .

The only course now is to indict and hold a trial "according to law".

So what *CRIME* is it that the Democrats are saying that TRUMP committed?

Justice Roberts knows he can't CONSTITUTIONALLY TRY TRUMP in the Senate
and he doesn't want that OBVIOUS lack of constitutional procedure
connected to himself for all eternity. He know that he will go down in
history like Benedict Arnold or John Wilkes Booth and John Hinkley Jr.
as traitors to the NATION.

Why would Harris not be eligible?
For starters, you cannot impeach an ex-president...
Trump was impeached while still President, but his term ended before her
could be tried. If Trump is convicted, the only punishment the Senate
may levy is to remove him from office, but he is already out of office.
There is nothing more to be done.
It is a trial without standing since the President is not in office
any more.
Wrong.  It still has the real possibility of disqualifying him, which
can and should be done.
No they can't disqualify a CITIZEN from holding office by impeaching
them.... if they can do that they will just impeach anyone who dare run
against the Democrats if they have any chance of winning.

It removes the Right of every Natural Born citizen to run for office.

And Roberts is mandated to be there for the Senate trial which means
that they can either have Roberts there or they're admitting that TRUMP
is NOT president and that they have no impeachment powers over TRUMP.
